The financial consulting firm and KROLL risks is faced with an in progress prosecution for an alleged negligent behavior on a data violation which had an impact on the creditors of FTX, Blockfi and Genesis.
The trial was filed on Tuesday before an American district court by lawyers on behalf of the FTX Jacob Repko client and other crypto creditors affected by Kroll data violation.
The prosecution claims that cryptographic creditors have faced phishing attacks, a cybercrime where malicious actors are trying to obtain sensitive information, due to a violation of data from Kroll in August 2023, in which malicious actors managed to obtain personal information on cryptographic creditors.
The complaint stressed that Kroll depended only on e-mail awareness only. In addition, the prosecution indicates that the process of verification of complaints has been compromised, which led to delays and even a loss of funds.
In addition to damages, the trial intends to solve the problem with which creditors were faced due to the single point of communication of Kroll.
In a Thursday X post, Sunil Kavuri, a leading FTX creditor, said the creditors received emails from phishing daily, showing that he had recently received one with his name included in the email of the scam.
In another screenshot, Kavuri shows that he received several phishing emails from August 14 to Sunday.
Another user replied by declaring that they had also received similar emails.
Nicholas Hall, bankruptcy and complex disputes among the lawyers in the room, replied to a user, telling them that eligible participants could obtain monetary compensation and could cause operational changes to Kroll according to the court decision.
Hall also operates the FTX complaints website to help FTX creditors with their respective complaints.
Earlier in March, Kroll would have undergone another data violation when details such as the invoicing of customers, the payable accounts and the email addresses were obtained by malicious actors.

Third round of the FTX reimbursement in September
The third cycle of reimbursement of FTX creditors should start on September 30, payment amounting to $ 1.9 billion.
Payment will probably exclude foreign creditors, who include creditors from China, Russia and more limited countries.
More than $ 5 billion was distributed in the second reimbursement cycle, which was announced in May.
In February, FTX established its plans to distribute $ 1.2 billion to users whose complaints were up to $ 50,000.
